From the 1950s through to its eventual ban in 1999, asbestos containing materials were used extensively in all manner of buildings and items. Given the popularity of asbestos and the long period during which it was used, it has been estimated that somewhere in the region of half a million commercial, public and industrial properties could very well still contain asbestos in some form.
As a result of the potential health hazards of exposure to asbestos, The Control of Asbestos Regulations were established. These regulations make duty holders of non-domestic properties legally obliged to both take accountability for and manage asbestos. The regulations are applicable to absolutely all industrial, commercial and public premises and even extend to communal areas of rented residential buildings. At the core of adherence to these regulations is the requirement that duty holders of certain premises carry out a comprehensive asbestos survey.
Prevention of the risk of exposure to hazardous asbestos particles is a vitally important issue. So much so, that the Health and Safety Executive (HSE) posses the authority to actively enforce adherence to regulations – with stern penalties levied against those who fail to comply.
If you are a duty holder you are legally obligated to:-
- Investigate whether your building contains asbestos
- Determine the condition of any asbestos that may be present
- Establish the risk of any asbestos containing materials by way of an asbestos survey
- Devise a risk management plan in the light of any findings
